Boulder DUI Attorney
Blood & Breath Tests
If an officer suspects that you are driving under the influence, he or she will request that you submit to a breath or blood test. The purpose of a breath or blood test is to determine if your blood alcohol concentration is .08 or higher. If the breath or blood test results indicate that your BAC is at or above .08, then you will be arrested and charged with DUI.
Breath Test v. Blood Test
- The breath test is conducted by blowing into a machine called the Intoxilyzer 5000. This machine measures the amount of alcohol in your deep lung region by reading a sample of your breath alcohol. It is believed that breath alcohol correlates with the amount of alcohol in the blood.
- To administer a blood test, a sample of your blood will be drawn for analysis in a laboratory. If the analysis indicates that your BAC is .08 or more, you will be formally charged with DUI.
Why Do I Need a Boulder DUI Lawyer?
If you were arrested on DUI charges after submitting to a breath or blood test, it’s in your best interest to retain the legal counsel of an experienced DUI attorney. Mistakes can occur easily during a breath or blood test, so it’s important to find an attorney who can identify when an error has taken place.
A breath or blood test can give an inaccurate reading due to:
- Operator error
- Technician error
- Machine error, defects, or malfunctions
- The machine was calibrated incorrectly
- Radio frequency interference
- Contaminated, broken, or defective testing equipment
- Too much time lapsing between the arrest and when the test was administered
